All rights to the visual materials in the database of Plants & Flowers Foundation Holland are owned by Plants & Flowers Foundation Holland or have been licensed to Plants & Flowers Foundation Holland. Plants & Flowers Foundation Holland makes these images available to third parties as a service for promotional purposes within the floriculture sector. The use of these images is subject to conditions. If the user does not comply with the conditions set by us, the right to use may be revoked immediately.

1) Use of the visual materials means any act or set of acts in relation to the materials, including but not limited to retrieving, consulting, using, distributing by means of forwarding, dissemination or any other form of making available, compiling, linking, as well as reproducing and publishing.
2) The right of use applies exclusively to the user themselves. Total or partial transfer of the right of use or granting of sublicenses by the user to a third party is not permitted.
3) The rights to the visual materials are and remain the property of Plants & Flowers Foundation Holland. The user is granted only a limited, non-exclusive, and revocable right of use by Plants & Flowers Foundation Holland.
4) The user is not permitted to use the visual materials in any way that could reasonably cause material or immaterial damage to Plants & Flowers Foundation Holland, the Dutch floriculture sector, and/or the creator.
5) If persons are depicted in the visual materials, such materials may not be used in a way to which those individuals could reasonably object.
6) The user must include the credit "Plants & Flowers Foundation Holland" when publishing the material.
7) The user is not permitted to alter the visual materials in any way.
8) Plants & Flowers Foundation Holland has the right to terminate the right of use with immediate effect if claims from third parties provide grounds for doing so. The user shall provide full cooperation in such cases.

Plants & Flowers Foundation Holland shall never be liable for consequences arising from the user’s use of the visual materials. The user shall indemnify Plants & Flowers Foundation Holland against all claims by any party concerning the user’s use of the materials. Likewise, Plants & Flowers Foundation Holland shall never be liable to the user for earlier or later use of the visual materials by third parties.
In the event of violation of the conditions by the user, a non-negotiable and immediately payable fine of €300 shall apply, and after being given notice of default, €500 for each day the violation continues, without prejudice to Plants & Flowers Foundation Holland’s right to claim full compensation from the user. Disputes between Plants & Flowers Foundation Holland and the user concerning the right of use shall be settled by the competent court in The Hague, under Dutch law.
